The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 120B of the Indian Penal Code.

As per prosecution case, allegation against the petitioner is that he has been appointment as Block Teacher in Block Sono, in the year of 2013, on the basis of forged educational certificate.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted vide para-9 of the petition that the petitioner has passed

Patna High Court CR. MISC. No.13870 of 2023(2) dt.26-04-2023 2/2 intermediate exam bearing Roll Code 738, Roll No. 110060 in the year of 1991 but the informant has sent for verification to the Bihar School Examination Board who has passed intermediate in the year of 1993 bearing Roll no. 738, Roll No. 10060 and thereafter it is natural that the name of appeared student is different and due to this the petitioner has falsely been made accused in the preset case. It is further submitted that the petitioner is languishing in judicial custody since 9.1.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sono P.S. Case No. 421 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Magistrate, 1st Class, Jamui.
