This application for anticipatory bail arises out of Bairiya P.S. Case No. 273 of 2020 for the offence punishable under Sections 363 and 366-A of the Indian Penal Code and under Section 12 of the POCSO Act.
Considered the order dated 16.08.2021 passed in Criminal Miscellaneous No.15429 of 2021, by which the main accused Sanjay Paswan has been granted regular bail. It has come in the order dated 16.08.2021 that the girl has found to be major and the girl in her statement recorded under Section 164 of the Cr.P.C. has stated that she married with Sanjay Paswan and was living with him as husband and wife.
Patna High Court CR. MISC. No.23268 of 2021(2) dt.09-03-2022 2/2 The petitioner is the elder brother of Sanjay Paswan. Considering the aforesaid facts, this bail application is allowed.
Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge-cum- Special Judge, under POCSO Act, West Champaran at Bettiah, in connection with Bairiya P.S. Case No. 273 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
