The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 403, 406 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that the informant being a lady of Scheduled Caste holds Ration Card. The informant went to the house of the petitioner to receive ration for the month of April and May, 2014 but the petitioner gave grains for the same month. When the informant asked to make supply then she was being abused by calling caste name. It is further alleged that the informant further along with her daughter- in- law Shiv Kumari went to the house of the petitioner, but both of

It is submitted by the learned counsel for the petitioner that for a petty dispute accusation has been levelled and the informant has retracted from the initial version and filed a petition to that effect before learned court below. For the occurrence of 02.03.2015 the complaint was filed on 07.04.2015 which came to be registered as police case on 10.05.2015.
Considering the delayed lodging of the case, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Denesh Kumar, J.M., Ist Class, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 39 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
