Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with S.Tr. No. 780 of 2022 arising out of Motipur P.S. Case No. 50 of 2022 registered for the offences punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution, the informant's father-in-law was shot by the FIR named persons over a dispute of land and money.

Patna High Court CR. MISC. No.13896 of 2023(2) dt.15-03-2023 2/3 The main submissions advanced by petitioner's counsel are that the petitioner earlier preferred Cr. Misc. No. 42126 of 2022 for the relief of regular bail which was rejected on 18.11.2022 by this Court and thereafter she has again filed the instant criminal miscellaneous petition for the same relief mainly on these grounds that firstly, the charges upon the petitioner have been framed on 18.11.2022, secondly the long custody period of the petitioner which is about more than one year and thirdly, co-accused Umesh Roy, whose prayer was also rejected by this Bench, has been granted bail on his second prayer vide order dated 04.01.2023 passed in Cr. Misc. No. 75003 of 2022 preferred by the said co-accused. Further submission is that the main allegation of causing firearm injury to the deceased is against co-accused person and petitioner is stated to be a member of the alleged conspiracy and she is an aged women having fair and clean antecedent.

Learned APP appearing for the State has opposed the prayer for bail.

In view of the fresh grounds taken by the petitioner as discussed above, the petitioner deserves to the privilege of bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
