This is an application for bail in connection with Naubatpur P.S.Case No. 345 of 2016 registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code. It has been submitted on behalf of the petitioner that on the basis of confessional statement a loaded truck has been recovered from the house of the petitioner but he has purchased the same from co-accused and he has remained in custody for three months having no criminal antecedent.
Heard learned APP also.
Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail
Patna High Court Cr.Misc. No.13867 of 2017 (2) dt.23-03-2017 2/2 after framing of charge before the court below, who will consider the entire allegation against the petitioner as also period in custody and pass an appropriate order. The learned court below is also directed to expedite committal of the case also. Accordingly, this application is dismissed.
