The petitioners being the mother and brother of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 498A, 304B, 201/34 of the Indian Penal Code. The prosecution case is of killing the daughter of the informant after one year of marriage by administering poison.
It is submitted by the learned counsel for the petitioners that only on suspicion accusation has been levelled against the entire family of the husband of the victim and in fact the victim went outside to ease out but since the area was flooded, she drowned in the water. Admittedly, there is no eye witness to the occurrence. Petitioners claim to be residing
Patna High Court Cr.Misc. No.8465 of 2016 (2) dt.19-02-2016 separately from the husband of the victim and have no concern with day to day affairs of the husband of the victim. It is further submitted that the informant was informed on 30.08.2015 about the victim being traceless, the informant came to the house of the husband of the victim and thereafter on 01.09.2015 the present case was registered.
Considering the thrust of accusation against husband of the victim, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Naugachia, Bhagalpur in connection with Gopalpur P.S. Case No. 194 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
