The petitioner seeks regular bail in connection with Khusarupur P.S. Case No. 297 of 2018 registered for the offence punishable under Sections 399, 402, 411, 413 and 414 of the Indian Penal Code.

The allegation is regarding four miscreants having been caught upon raid having been made by the Police upon receipt of secret information that some miscreants have gathered for committing some crime and upon their confessional statement, raid was committed in the house of the petitioner and two motorcycles and one mobile phone were recovered. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and

No.11366 of 2019(2) dt.25-02-2019 2/2 in fact he has categorically stated in paragraph no. 15 of the bail petition that both the motorcycles and the mobile phone belong to the petitioner herein. It is submitted that the prosecution has not been able to establish till date that the motorcycles were stolon motorcycles. Lastly, it is submitted that the petitioner has a clean antecedent and is languishing in custody since 21.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, Patna in connection with Khusarupur P.S. Case No. 297 of 2018.
