JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 385, 386, 417 and 419/34 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act. The accusation is of demanding extortion from the truckers. During investigation, it was found that the motorcycle registered in the name of mother of Azit Singh was used by Ashok
Patna High Court Cr.Misc. No.12413 of 2015 (3) dt.03-04-2015 2/2 Chaudhary. Ashok Chaudhary has been charge sheeted. It is submitted by learned counsel for the petitioners that the investigation against the petitioners is still pending. It is alleged against the petitioners that they were seen fleeing away from the place of occurrence by the Chaukidar. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Udwant Nagar P.S. Case No. 351 of 2014 pending in the court of learned CJM, Bhojpur, Ara. Accordingly, the application is disposed of.
