====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-05-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 212, 216, 224, 225, 353 and 34 of the Indian Penal Code. The informant alleges that on information he had gone to apprehend Rajesh who had visited the house of Mahesh and the petitioner, it is next alleged that when the informant reached the place of occurrence, Rajesh was arrested but the petitioner along with Mahesh started quarreling with the police force and taking advantage of the same Rajesh fled.
Learned counsel for the petitioners submits that the petitioner no. 1 is a woman and subsequent to filing of the
Patna High Court CR. MISC. No.13191 of 2023(2) dt.25-05-2023 2/2 present anticipatory bail application, they got implicated in one case. The learned counsel for the petitioner next submits that petitioner has been falsely implicated in the present case, it is next submitted that petitioner has no concern with Rajesh nor being a woman she would have fought with the police force. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Arwal Mahila P.S. Case No. 21 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
