This application is for grant of bail in connection with Darpa P.S.Case No.74 of 2016, G.R. No.887 of 2016 for the offence under Sections 272, 273/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that though the allegation is that 80 ltrs. of Nepali liquor have been recovered, however, it has been recovered from the joint possession of six persons, out of them, four persons fled away and two persons including the petitioner were arrested. The petitioner has criminal antecedent and he has remained in custody for about three months. Heard learned A.P.P. also.
Having heard both sides. In view of the fact that a huge quantity of liquor has been recovered, I am not inclined to grant
Patna High Court Cr.Misc. No.7965 of 2017 (2) dt.23-02-2017 2/2 bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after completion of six months of the period in custody.
With the aforesaid observation, this application is dismissed.
