JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard the learned counsel for the petitioner, the informant and the State.

This is a petition for grant of regular bail for offences under Sections 147, 148, 149, 341, 323, 324, 504 and 302 of the Indian Penal Code.

According to first information report, on the order of the co-accused, Kheda Mian, one Chhotak Mian assaulted with a bamboo causing injury at the head of the deceased and, thereafter, others also assaulted. The post mortem report reveals that only one wound on parietal region was found, which was laceration and other two injuries were present on occipital region and on the bridge of nose of the deceased.

The learned counsel for the informant opposed

Since, there is no specific attribution against the petitioner, Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Yogapatti (Sanichari) P.S. Case No. 314 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, VI, West Champaran at Bettiah, or successor Court.
