2. In this case, the petitioners are seeking regular bail in connection with Mirganj P.S. Case No. 606 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118, 109, 352, 351(2) and 3(5) of the BNS, 2023.

3. On 19.12.2024 at around 2:00 PM, the informant saw the accused persons namely Aash Lal Tatwa, Ram Naresh Tatwa, and Mishri Tatwa, who were illegally constructing house on his land. When the informant's uncle Raja Rai objected, Aash Lal threatened them and directed the others to kill them. Aash Lal

Patna High Court CR. MISC. No.13817 of 2025(3) dt.09-05-2025 2/2 assaulted the informant on his head with a spade, causing him to fall. Further, Ram Naresh and Mishri Tatwa assaulted Raja Rai on his head with iron rods, resulting in serious injuries and unconsciousness. Thereafter, both the injured persons were taken to Sadar Hospital for treatment.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Admittedly, there is land dispute between the parties and both the parties have suffered grievous injuries. There is case and counter case. The petitioners are under custody since 20.12.2024 and they are the persons of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Gopalganj in connection with Mirganj P.S. Case No. 606 of 2024, subject to the following condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
