JUSTICE SUDHIR SINGH ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 3 of the RP (UP) Act. Allegation is that huge amount was committed theft by unknown persons from the Railway Booking Office and petitioner's name has come on the basis of confessional statement of co-accused Pankaj Kumar Singh.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. The name of the petitioner has come on the basis of confessional statement of co-accused Pankaj Kumar Singh in course of enquiry. The amount in question is said to have been recovered from the possession of Pankaj Kumar Singh. Except for confessional statement of the co-accused, there is no other material to suggest his implication in the present case. The other co-accused has been granted anticipatory bail vide Cr. Misc. No. 7551 of 2016.
On behalf of the State, it is submitted that petitioner is not named in the prosecution report.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.8913 of 2016 (3) dt.12-04-2016 2/2 above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate (Railway), Ist Class, Samastipur, in connection with R.P.F. (S.P.J.) P.S. Case no. 3 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
