JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 19-02-2018 Heard learned counsel for the State. No one appears on behalf of the petitioner. Even on 13.2.2018 none had appeared on behalf of the petitioner.

In the counter affidavit filed on behalf of the respondent Nos. 1 and 2 stand has been taken in paras-8 & 10 that a revised LPC has already been issued on 26.4.2017 and the deducted amount has already been paid to the petitioner. Paras 8 and 10 of the counter affidavit are quoted below:

That with regard to the statements made in paragraph no. 10 of the writ petition under reply herein, it is humbly stated that annexure-

Patna High Court CWJC No.15123 of 2016 dt.19-02-2018 2/3 2 to the writ petition was examined and compared with the original available in the office of the University and, thereafter, a revised LPC dated 26.04.2017 has already been issued. Photo copy of the revised LPC dated 26.04.2017 is attached herewith and marked as Annexure-R/1 to this counter affidavit.

That with regard to the statements made in paragraph no. 14 of the writ petition under reply herein, it is humbly stated that the deducted amount i.e. Rs. 15,806/- has already been paid to the petitioner vide cheque no.

006024 dated 26.04.2017 of Allahabad Bank ARI, Patna Branch. Photocopy of cheque no.

006024 dated 26.04.2017 is attached herewith and marked as Annexure-R/2 to this counter affidavit."

In view of the above stand taken by the respondents, the court does not find any point to keep the writ petition pending. The writ petition is disposed of in the light of the statements made in para nos. 8 and 10 of the counter affidavit. However, liberty shall be available to the petitioner that if he has any subsisting grievance, he may agitate the grievance before the respondent- authorities within a period of one month from today.
