JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 10-03-2017 By the impugned order dated 07.02.2015, passed by the learned Principal Judge, Family Court, Aurangabad in Miscellaneous No. 42 of 2011, the petitioner has been directed to pay sum of Rs. 7000/- per month as maintenance allowance to the opposite party, who is admittedly his wife.

What emerges from the impugned order and materials on record is that there is no dispute about the fact that the petitioner has solemnized marriage with another lady during survival of his first marriage which is still surviving with opposite party. A case, therefore, is made out constituting reason for the opposite party to reside away from the company of the petitioner and claim maintenance at an appropriate rate. It also transpires that the petitioner

Patna High Court CR. REV. No.228 of 2015 dt.10-03-2017 2/2 has been found to be running a Pathological Centre at Goh, Aurangabad from which he has sufficient earning. In such circumstance direction by the court below to pay monthly maintenance allowance of Rs. 7000/- per month under Section 125 of the Cr.P.C requires no interference.
