JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 504 of the Indian Penal Code.

The prosecution case is that the informant being the owner and proprietor of Rajasthan-Haryana Transport company received an extortion demand call of `50,000/- from the petitioner and in case of non-payment, threat to implicate in false cases was made.

It is submitted by learned counsel for the petitioner that the informant sides misappropriated the rice being transported from the transport company of the informant leading to registration of Mohania P.S. Case No. 162 of 2014 against the

Patna High Court Cr.Misc. No.9095 of 2016 (3) dt.29-02-2016 2/2 informant's transport company and thereafter the present case has been registered. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the case lodged by the petitioner's at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabua) in connection with Mohania P.S. Case No. 91 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
