JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 302 of the Indian Penal Code, Section 27 of the Arms Act and Sections 37(b)(c) of the Bihar Prohibition & Excise Act, 2016.

It is a case of commission of murder of the petitioner who is alleged to have shot fire at his own son.

No.11958 of 2022(4) dt.17-01-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is father of the deceased Raju Kumar Singh who has committed suicide on account of frustration due to unemployment. The wife of the petitioner in her written application as recorded in para 26 of the case diary has stated that on the alleged date of occurrence while she and her husband (petitioner) were on the rooftop of the house, suddenly they heard sound of firing from the room of their son. They rushed to the room and found their son injured due to gunshot and licensee gun of her husband was lying there. The petitioner is retired Army Personnel and is rotting in jail since 23.09.2021.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Gopalganj in connection with
