JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 387/504/506 and 34 of the Indian Penal Code.

It is alleged that earlier the informant filed Kanti P.S. Case No.316 of 2013 when his son was killed. The accused were threatened to get the earlier case withdrawn/compromised and extortion of Rs.1,00,000/- was also demanded through mobile no.9096247983.

It is submitted by learned counsel for the petitioner that accused persons disclosed their names to the informant as Sanjay Kumar Singh, Arvind Kumar Singh and Rajeev Kumar Singh. The petitioner is not accused in earlier case being Kanti P.S. Case No.316 of 2013 and the alleged mobile number

Patna High Court Cr.Misc. No.13299 of 2015 (2) dt.01-04-2015 2/2 through which the extortion was demanded is not registered in the name of the petitioner. A statement is made in paragraph 3 of the petition that petitioner carries no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for a period of six months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No.340 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of petitioner will be confirmed by the learned court below, on the fact during investigation that the mobile through which the extortion was demanded is not registered in the name of the petitioner otherwise the petitioner will surrender and pray for regular bail.
