The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
It is a case of dowry death due to non-fulfilment of dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner was not apprehended at the spot. He further submits that the cognizance has been taken under Section 306 of the IPC.
Patna High Court CR. MISC. No.23004 of 2021(5) dt.23-03-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.
From perusal of the entire facts and circumstances as also the case diary which is available on record, it appears that the petitioner is the husband of the deceased and is legally weeded wife and all responsibility is fixed from the petitioner in respect of the deceased and deceased was died at the house of the petitioner and also the fact that the processes of 82 and 83 of the Cr.P.C. has already been taken against the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
