The petitioner seeks bail in a case instituted under Sections 387 of the Indian Penal Code and Section 17 of C.L.A. Act.

It is alleged that the petitioner threatened the informant and demanded ransom of 5 percent of levy on the cost of total construction otherwise the building will be blasted. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.11.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The charge sheet has been submitted in the present case. The petitioner has been made

Patna High Court Cr.Misc. No.8457 of 2017 (2) dt.15-03-2017 2/2 accused due to mistake of fact. There is no substantive evidence to suggest his implication in the present case, except for suspicion.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and ransom was demanded on behalf of the petitioner by other co-accused persons. The petitioner is involved in Maoist activity.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner 'at this stage'. The same is rejected in Sherghati P.S. Case No. 553 of 2016, pending in the court of learned A.C.J.M., Sherghati, Gaya. (Sudhir Singh, J) Amit/- U T
