BAJANTHRI ORAL JUDGMENT Date : 16-02-2022 The matter has been heard via video conferencing due to circumstances prevailing on account of the COVID-19 circumstances.

In the instant petition, petitioner has prayed for the following relief/reliefs:

"(I) To quash the order dated 22.06.2019 passed by the Commandant UIN 13040002 46th Bn.

Patna High Court CWJC No.9096 of 2021 dt.16-02-2022 2/3 SSB, Malbazar (W.B.) (Respondent No.-9) as contained in Annexure-9 by which the petitioner has been discharged from the service. And for a direction to reinstate the service of petitioner on the post of constable in SSB, 46 Battalion.

(II) To quash the order dated 19.11.2019 issued vide memo no.- 7061-64 passed by the Deputy Inspector General, SHO, SSB, Jalpaiguri, W.B. (Respondent No.-8) as conained in Annexure-11 by which the service appeal filed by this petitioner u/s 39 of SSB, Rule 2009 has been rejected.

(III) To pass such other order/orders as may deem fit and proper under the facts and circumstances of the instant case."

From perusal of the pleadings, it is evident that this Court has no territorial jurisdiction so as to examine the

Therefore, the present petition stands disposed of reserving liberty to the petitioner to approach territorial jurisdiction Court.
