Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Bettiah (T) P.S. Case No. 460 of 2022 dated 18.06.2022 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 338, 395, 427, 435, 412, 120B, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the petitioner is accused of being part of the mob which had tried to commit arson and riot.

Patna High Court CR. MISC. No.19848 of 2023(2) dt.22-05-2023 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The co-accused person has already been granted bail by the Coordinate Bench of this court vide order dated 04.03.2023 passed in Cr. Misc. No. 673 of 2023. The petitioner is accused in four other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 11.08.2022.

Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bettiah, West Champaran in connection with Bettiah (T) P.S. Case No. 460 of 2022.

The application stands allowed.
