JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 363, 364, 365, 368, 367, 120B, 379 and 506/34 of the Indian Penal Code.
The accusation is of kidnapping the son of the informant for the purpose of marriage, assaulting the informant and his son and snatching `5,000.
It is submitted by learned counsel for the petitioners that the petitioners are the parents, brother and cousin of the victim girl with whom the son of the informant has already married. Both sides have entered into compromise and filed a petition to that
Patna High Court Cr.Misc. No.5874 of 2015 (2) dt.13-02-2015 2/2 effect before the learned court below. Petitioners' side also lodged a case being Daraunda P.S. Case No. 117 of 2014 against the informant for kidnapping of the daughter of petitioner nos. 1 and
2. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., Siwan in connection with Daraunda P.S. Case No. 181 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
