The petitioner seeks bail in Halsi P.S. case No. 133 of 2016 under Section 366(A), 342/34 of the Indian Penal Code and under Section 8 of the POCSO Act.
The maternal grand mother of the victim alleged that petitioner kidnapped her minor grand daughter for the purpose of marriage.
It is submitted that the victim appeared and made her statement under Section 164 of the Cr. P. C. The victim disclosed that she came to a fair and called Pankaj, the petitioner. The victim and Pankaj went to Ashok Dham and solemnized marriage. It is submitted that petitioner did not kidnap the victim but the victim persuaded the petitioner and took her for marriage. Patna High Court Cr.Misc. No.9422 of 2017 (2) dt.13-04-2017 2/2 assessed the age of victim to be 19-20 years. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in Halsi P.S.
