It is submitted on behalf of petitioner No. 2 that he has been taken into custody and, therefore, the application as against petitioner No. 2 has become infructuous.
The application as against petitioner No. 2 (Praduman Singh @ Parduman Singh) is dismissed as having become infructuous. So far as the petitioner No. 1 is concerned, he apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/148/149/323/324/307/354/379 and 504 of the Indian Penal Code.
From perusal of the First Information Report, it reveals that there was an attack made by these petitioners, but the injuries
Patna High Court Cr.Misc. No.8377 of 2016 (3) dt.02-05-2016 P2/2 purported to have been made, do not match with the injury report. Considering the aforementioned facts and circumstances and also the fact that the petitioner has no criminal antecedent, let the petitioner No. 1 Bade Ji Singh @ Bade Singh, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Siwan in connection with Nautan P.S. Case No. 74/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
