Petitioner is in custody since 07.02.2016 in connection with S.Tr. No. 462 of 2016 arising out of Kochas P.S. Case No. 13 of 2016 registered under Sections 302, 120(B) of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, has falsely been implicated in this case due to enmity. In fact, the petitioner has not been named in the F.I.R. and merely on the basis of suspicion, he has been dragged in this case. No any witnesses have supported the implication of this petitioner in the alleged occurrence. The petitioner is rotting in custody for the last 11 months.

Considering the nature of accusation, let the petitioner,

Patna High Court Cr.Misc. No.5435 of 2017 (5) dt.19-04-2017 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Rohtas at Sasaram in connection with S.
