The petitioners have preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 341, 324, 326 and 379 of the Indian Penal Code. As per the prosecution case, on a dispute over a game of Volleyball, it is stated that the ten named accused persons including the four petitioners herein armed with knife etc. started to abuse and assaulted the nephew of the informant. On other persons going to his rescue, the accused persons also assaulted them causing serious injuries.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in

There is case and counter case between the parties and the correct version having been narrated in the F.I.R. of the counter case which is Annexure-2 to the petition. It is submitted that the case of the petitioners stands on a similar footing to that of three other F.I.R. named co-accused who have been enlarged on bail vide order dated 2.12.2020 (Annexure-4) passed in Cr. Misc. no.31351 of 2020. The petitioners are in custody from different dates for a period more than 9 months and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, grant of bail to the three other similarly situated coaccused together with the petitioners having remained in custody for over 9 months, the Court directs the petitioners to be enlarged on bail in connection with Shahpur P.S. Case no.147 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bhojpur, Ara.
