1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Excise Arrah P.S. Case No. 375 of 2021 dated 22.08.2021 registered under Section 30 (a) of the Bihar Prohibition & Excise (Amendment) Act 2018.

3. As per the first information report Excise Officials got secret information that near the poultry farm of the petitioner, illegal wine has been kept. The Excise Officials reached the place of occurrence and recovered 10 liters of country made liquor beside the poultry farm of the petitioner kept under the bricks.

4. Learned counsel for the petitioner submits that petitioner is having no criminal antecedent and he has been made accused on

Patna High Court CR. MISC. No.18066 of 2026(2) dt.08-04-2026 2/2 the basis of secret information. Country made liquor has not been recovered from the premises belonging to the petitioner but has been recovered from an open space accessible to all and sundry.

5. Regard being had to the submission made by the parties, taking into consideration the fact that liquor has not been recovered from the premises owned by the petitioner and the petitioner is having no criminal antecedent , accordingly, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2nd, Bhojpur, Arrah in connection with Excise Arrah P.S. Case No. 375 of 2021 subject to the condition as laid down under Section 482 (2) of the B.N.S.S.
