2. The petitioner is apprehending his arrest in connection with Malsalami P.S. Case No. 629 of 2025 for the offence under Sections 191(1), 191(2), 191(3), 126(2), 115(2), 118(1), 109(1), 324(4), 74, 308(3), 352, 351(3) and 79 of the BNS.

As per the prosecution story, the informant has alleged that on 07.12.2025 he received information from the security guard of the showroom that about 40-50 persons had unlawfully entered the showroom premises with two tractors carrying bricks and sand and several bags of cement, and were attempting to forcibly raise brick wall near the main gate with

On receiving the said information, he reached at the showroom where he found all the F.I.R. named accused persons, unlawfully assembled inside the showroom. They were abusing and physically assaulting his security guard and other staff members. It is also alleged that accused persons assualted the informant as well as his family members. Further, Sonu @ Naushad Khan criminally intimidated the informant by demanding a monthly ransom of Rs. 5,00,000/- for allowing him to run the showroom.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is contended that no specific overt act has been attributed to the petitioner. The petitioner is neither alleged to have assaulted anyone nor to have been armed at the time of the occurrence. There is no allegation that he have any threat, committed extortion, or caused any injury or damage to person. Learned counsel further submits that learned Sessions Court, in the impugned order dated 29.01.2026, has itself recorded that civil proceedings are pending with respect to the disputed land.
5. Learned APP opposes the prayer for bail.
6. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Patna City, in connection with Malsalami P.S. Case No. 629 of 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
