The petitioner is languishing in custody since 09.02.2018 in connection with Khagaul P.S. Case No.25 of 2018 registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

Prosecution case as per the FIR is that from the possession of the petitioner one country made pistol loaded with live cartridge were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is remained in custody for more than a year. Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that the recovery has been made from the conscious physical possession of the petitioner and the

Considering the fact that the investigation has already completed and the period of custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Danapur in connection with Khagaul P.S. Case No.25 of 2018, with a condition that petitioner shall not indulge in any similar offence till conclusion of the trial and the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court below.
