JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 427, 504/34 of the Indian Penal Code.

It is alleged that the co-accused Sukhari Rai assaulted on the head of the informant with Farsha when the husband of the informant came to rescue he was also assaulted by the petitioners and the accused person also taken away some cash and kind from them. It is submitted by learned counsel for the petitioners that injuries sustained to the informant and her husband are simple in nature. Though accusation of assault by 'farsa' is levelled against non-petitioner Sukhari Rai and there is counter versions of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners

Patna High Court Cr.Misc. No.12717 of 2015 (2) dt.26-03-2015 2/2 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran in connection with Phenhara P.S. Case No.50 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
