JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Patahi P.S. Case No.335 of 2019 registered under Section 354A of the Indian Penal Code, 1860, besides Section 8 of the POCSO Act. The accusation is that on 04.11.2019 at about 11.00 A.M., the daughter of the informant Bigu Mahto, aged about 12 years, had gone into the field to graze the goat. In that course, one person came on the bicycle and tried to take the daughter of the informant by pressing her mouth for bad purpose. Thereafter, on the alarm being raised by another boy, nearby people rushed there and caught hold that person, who disclosed his name as Mintu Singh (petitioner). In course of fleeing

Learned counsel appearing on behalf of the petitioner submits that the village of the petitioner and the informant is adjacent to each other. In the election of Mukhiya, the family members of the petitioner had supported another Mukhiya and due to dirty village politics and political rivalry, the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent and is in custody since 05.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge at Motihari, East Champaran, in connection with Patahi P.S. Case No.335 of 2019.
