The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 419, 420, 467, 468, 471, 472 and 120B/34 of the Indian Penal Code.
It is alleged that the informant's land was transferred by executing a sale deed by Govind Das Shastri in favour of Remi Kumari Pandey @ Remi Pandey. The petitioner was a witness to the alleged sale deed.
It is submitted by learned counsel for the petitioner that Remi Kumari Pandey and other witnesses to the sale deed namely, Abhay Kumar Pandey @ Abhay Pd. Pandey and Subhash Chandra Rai have been granted bail by this Court vide order
Patna High Court Cr.Misc. No.8940 of 2015 (2) dt.04-03-2015 2 / 2 dated 11.02.2014, passed in Cr. Misc. No. 53642 of 2013, the order has been brought on record as Annexure-2.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kotwali (Tatarpur) P.S. Case No. 630 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
