Petitioner is seeking anticipatory bail in connection with Bhagwanganj P.S. Case No.72 of 2018 registered for the offences punishable under Sections 341, 323, 504, 506, 307 and 34 of the Indian Penal Code.

A perusal of the records shows that in Paragraph 3 of the present application the petitioner has stated that he has no criminal antecedent. Further it is stated that the petitioner and the informant are own 'Gotiyas-cum-own Uncle' and there is dispute between them with regard to some ancestral properties.

Learned APP for the State has drawn the attention of this Court towards Annexure '4' to the present application from which it appears that one Dharmendra Yadav and another Bhuneshwar Yadav @ Bhoneshwar Yadav have been granted the privilege of anticipatory bail by a learned Coordinate Bench of this Court in Cr. Misc.

Patna High Court CR. MISC. No.11345 of 2019(2) dt.26-02-2019 2/2 No.78746 of 2018. The allegation against this petitioner is said to be that he had also assaulted the informant and had caused simple injury. Learned A.P.P. further submits that so far as allegation against this petitioner is concerned, it is same and similar allegation which are leveled against the two petitioners in Cr. Misc. No.78746 of 2018.

In the aforesaid circumstance, in order to maintain uniformity in justice, this Court is willing to grant privilege of anticipatory bail to the petitioner. In case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned J.M 1st Class, Masaurhi in connection with Bhagwanganj P.S. Case No.72 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation.
