JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Budha Colony P.S. Case no. 278 of 2019, registered under Sections 471, 354(b)(c), 341, 323, 504, 386, 387, 379, 380 and 120(B)/34 of the Indian Penal Code.

The accusation is that complainant/informant Sangita Singh @ Sangita Ranjan is in possession of half portion of the house of her father Late Sitaram Gope since his life time and half portion was in possession of his brother, namely, Sanjeev Singh and her brother Sanjeev Singh let out his half portion of house to Sanjeev Kumar (Petitioner), but before some days, the petitioner got executed agreement

Patna High Court CR. MISC. No.12807 of 2020(2) dt.02-07-2020 2/3 regarding whole portion of the house/premises and started to gather the miscreants there and, occasionally, used to misbehave with her. The petitioner told her that her brother Sanjeev Singh has prepared forged document of whole portion and he is trying to execute the sale deed. On 15.06.2019, she had gone to attend marriage ceremony and when she returned on the next morning then saw that lock of her room was broken and ornaments as well as cash of Rs.15,000/-, kept in a bag, are missing. When she asked to the petitioner then petitioner put pistol at her temporal region and he also snatched her purse containing cash of Rs. 2-3 thousand and he also gave threatening to leave the house.

Learned counsel for the petitioner submits that, in fact, co-accused Sanjeev Singh let out his half portion of house/premises to the petitioner in which complainant also used to reside in half portion and to grab the whole portion of house, the complainant filed Complaint Case No. 3149 (C) of 2019, which is the basis of the present case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below
