2. The petitioner has prayed for bail in connection with Tatarpur P.S. Case No.79 of 2025 registered for the offence punishable under Sections 191(1), 190, 115(2), 117(2), 109(1) and 303(2) of B.N.S.

3. The case of the prosecution, in short, is that the petitioner along with others arrived and one Md. Sagar has assaulted the informant with a dagger.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. itself it is clear that the petitioner is only a member of mob. No overt act is alleged

Patna High Court CR. MISC. No.13698 of 2026(2) dt.12-03-2026 2/2 against him. It has further been submitted that the co-accused Md. Sagar against whom there is specific allegation of assault, has been granted bail by this Court vide Cr. Misc. No. 10427 of 2026. The case of this petitioner stands on better footing. Moreover, he is languishing in judicial custody since 13.01.2026.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Bhagalpur in connection with Tatarpur P.S. Case No. 79 of 2025.
