This is an application for bail in connection with Deepnagar P.S.Case No. 217 of 2016 registered for the offences punishable under Sections 25(1B)a and 26 of the Arms Act. As per FIR one country made pistol with cartridge has been recovered from the petitioner.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and has remained in custody for three months.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and considering the allegation as well as period of detention, I am not inclined to grant

Patna High Court Cr.Misc. No.7132 of 2017 (2) dt.20-02-2017 2/2 bail to the petitioner at this stage. However, he may renew his prayer for bail after completion of six months in custody before the court below itself, which shall be considered by the court below keeping in view the period of detention, without being prejudiced by this order.

With the aforesaid observations, this application is disposed of.
