The petitioner seeks bail in a case instituted for the offence under Sections 302, 201 and 120(B)/34 of Indian Penal Code.

It is alleged that the informant received information that a dead body is lying near Vadi Nagar, Karahagola. The informant went there and identified the dead body as his daughter, namely, Pinki kumari. The informant has suspicion that this petitioner and other accused have murdered his daughter on account of property dispute.

From the written report itself, it appears that there is no any allegation of overt act against this petitioner. Learned

Patna High Court Cr.Misc. No.5663 of 2017 (2) dt.23-02-2017 2/2 Sessions Judge has written very cryptic order without mentioning the material from the case diary but from the order of the learned Sessions Judge, it appears that there is no material against this petitioner. The sessions Judge is advised to write detail order after discussing the material available in the case diary. Petitioner is brother-in-law of the deceased and he is in custody since 27.11.2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Barari P.S. Case No. 213 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
