JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner is in custody in Rosera P.S. Case No.209 of 2011 registered under Section 392 of the Indian Penal Code. Allegation in brief is that some cash was robbed by some miscreants when the informant was returning back to his home.

Submission is that this petitioner is not named in the First Information Report and merely on a confessional statement of the co-accused, his name transpired during investigation. However, the impugned order itself reflects that the accused persons were not put on Test Identification Parade and further submission is that nothing has been recovered from the possession of the petitioner and he has been in custody since 28.04.2012.

No.6798 of 2017 (3) dt.23-02-2017 2 / 2 Having considered the said facts and circumstances, let the petitioner, namely, Vicky Singh @ Vicky Kumar Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera at Samastipur, in connection with Rosera P.S. Case No.209 of 2011.
