The petitioner seeks bail in Roshanganj (Banke Bazar) P.S. Case No. 31/2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and 3, 4 and 5 of Explosive Act.
The petitioner is, of course, named in the FIR, but he was not arrested on the spot. The informant, police officer, on mere suspicion, named the petitioner and alleged that on secret information of assemblance of Naxalites in Jungle, they went there, but seeing the police party, Naxalites fled away. Similarly situated co-accused Kapil Paswan and Bindu Bhuian have already been granted bail. The petitioner is in custody since 14.09.2016. He has already remained in jail for more than seven months. No.11893 of 2017 (4) dt.17-04-2017 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Roshanganj (Banke Bazar) P.S. Case No. 31/2014.
