ANJANA PRAKASH ORAL ORDER 04-02-2015 Heard learned counsel for the Petitioner and the State. The Petitioner was allowed Provisional anticipatory bail by the order dated 1.5.2014.
In the nature of dispute between the Parties, notices have been issued to the Opposite Party No. 2 but none appears on her behalf.
Considering the merits of the case, Provisional anticipatory bail granted to the Petitioner by the order dated 1.5.2014 in connection with Complaint Case No. 606(C) of 2012 to the satisfaction of Sub Divisional Judicial Magistrate, Danapur, Patna, is hereby confirmed on the same terms and also that the Petitioner will give an undertaking that he will receive the police
Patna High Court Cr.Misc. No.10871 of 2014 (4) dt.04-02-2015 2/2 papers on the given date and be present on date fixed for charge and if he fails to do so on two given dates and delays the trial in any manner, his bail will be liable to be cancelled for reasons of misuse. (v) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
It has been submitted that the Complainant is not appearing for the last many dates. Let Notices be issued to the Complainant to enquire as to whether she wishes to proceed with the Complaint or not. If not, the proceeding be dropped. (Anjana Prakash, J) S.Ali/- U T
