The petitioner apprehends his arrest in Complaint case No. 1486 of 2018 for the offences allegedly committed by the petitioner under Section 498A, 406, 379, 323, 504, 506 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is husband of complainant. The complainant, of course, filed complaint case but later on good sense prevailed between the husband and wife and now the complainant is living happily with her husband. The complainant has sworn affidavit on behalf of her husband.

Considering the facts aforesaid and nature of

No.13024 of 2019(2) dt.05-03-2019 2/2 allegation made against the petitioner and the fact that complainant herself filed affidavit on behalf of her husband in this petition that she has restored marital relation with petitioner and she is living with her husband happily, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the lime amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Bhagalpur in connection with Complaint case No. 1486 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
