The petitioner apprehends his arrest in connection with Excise Case No. 919 of 2020 arising out of Parasi P.S. Case No. 64 of 2020 registered under Section 30(a) of Bihar Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is not named in the first information report. Anil Kumar Tanti is the driver of the vehicle of the petitioner. Without the knowledge of the petitioner, he used the vehicle in the alleged occurrence. Further he submits that petitioner has no concern with the illicit recovery. His name has been transpired

Patna High Court CR. MISC. No.22051 of 2021(5) dt.07-04-2022 2/2 only because he is the owner of the vehicle from which the illicit recovery has been made. Petitioner is a man of clean antecedent. It is also submitted that on perusal of the first information report, it would be evident that driver disclosed the name of the wine owner as Ranjan Choudhary and also disclosed the name of the escaper as Pintu Nut and Bijay Choudhary.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise, Patna in connection with Excise Case No. 919 of 2020 arising out of Parasi P.S. Case No. 64 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
