2. Perusal of the documents annexed to the petition shows that the order passed by the District Program Officer, Nalanda, Bihar dated 11.04.2019 (Annexure-P-8) has already been challenged by the petitioner by way of filing an appeal before the District Magistrate, Nalanda, Bihar vide

Patna High Court CWJC No.4055 of 2025(2) dt.07-04-2025 2/2 Annexure-P-9. This fact has also been mentioned in paragraph 22 of the petition.

3. According to the learned counsel for the petitioner, the appeal (Annexure-P-9) has already been filed by petitioner and the same is still pending before the District Magistrate, Nalanda, Bihar

4. Since the remedy available to the petitioner has been availed by filing an appeal and the same is pending consideration, therefore, it would be appropriate, at this stage, to direct the District Magistrate, Nalanda, Bihar to consider and decide the pending appeal i.e Annexure-P-9 in accordance with the relevant Rules and law and pass a reasoned order as early as possible, preferably, within a period of 30 days from the date of this order.

5. However, the petitioner would be at liberty to file fresh petition, if occasion will arise subsequently.

6. With the aforesaid observation and direction, this petition stands disposed of.
