ANJANA MISHRA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302 and other sections of the Indian Penal Code.

Learned counsel for the petitioners submits that earlier final form in the case has been submitted under the bailable sections and, therefore, this petitioner has taken recourse to provision of Police bail. However, after lapse of eighteen years, now cognizance has been taken for the offence against these petitioners under Section 302 as well.

Considering the fact that petitioners were earlier on Police bail, let the petitioners abovenamed, in the event of their arrest /

Patna High Court Cr.Misc. No.17761 of 2015 (2) dt.10-09-2015 P2/2 surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 12/96 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
