JUSTICE ARVIND SRIVASTAVA ORAL ORDER 15-02-2017 Learned counsel submits that during the pendency of this application, petitioner no. 1 has been arrested, and as such, this application has become infructuous against petitioner no. 1. In view of the above, the application stands dismissed as infructuous.

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Tarabari P.S. Case No. 81 of 2016 registered under Section 420, 406, 467, 471, 120B of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the dispute between the parties is civil in nature. Against petitioner no. 2 there is only general and omnibus allegations.

No.3804 of 2017 (2) dt.15-02-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner no. 2 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kuamr II, Additional Chief Judicial Magistrate V, Araria in connection with Tarabari P.S. Case No. 81 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
