JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 394/395/412 of the Indian Penal Code.
The F.I.R. of the occurrence of dacoity is against unknown criminals. In the confessional statement of the coaccused name of the petitioner transpired and the said accused has already been granted bail by a coordinate Bench of this Court in Cr. Misc. No.6917 of 2017.
The petitioner has stated on oath that he has got no criminal antecedent and nothing has been recovered from the possession of the petitioner nor the petitioner has put on Test
Patna High Court Cr.Misc. No.11256 of 2017 (2) dt.20-03-2017 2/2 Identification Parade. Petitioner is in custody since 10.11.2016. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Munger/Successor Court, in connection with Sangrampur P.S. Case No.147 of 2015.
