The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant. In the statement of the victim girl recorded under section 164 of the Cr.P.C, she got her age recorded as 16 years whereas the doctor assessed her age between 17-18 years. The victim stated that she was kidnapped by Chanki Paswan, Mintu and Shailendra.
It is submitted by learned counsel for the petitioner that the victim was in love with co-accused Chanki Paswan and she was residing with Chanki Paswan at Indaur from where she
Patna High Court Cr.Misc. No.14690 of 2015 (3) dt.05-05-2015 2/2 was recovered by the police. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that the victim was recovered with co-accused Chanki Paswan and the petitioner has no criminal antecedent, it is a fit case for consideration of regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nokha P.S. Case No.9 of 2014, pending before the learned Chief Judicial Magistrate, Sasaram, Rohtas.
With the above observation, this application is, accordingly, disposed off.
