Petitioner is accused in connection with Baisi P.S. Case No. 190 of 2016 registered under Section 273 of the I.P.C. and section 30A of the Bihar Excise Amendment Act. Learned counsel for the petitioner submits that petitioner is the driver of the vehicle and has no concern with the goods/materials loaded on his vehicle. None of the witnesses have supported the recovery from the conscious possession of the petitioner. It is submitted that petitioner has no criminal antecedent and is in custody since 13.11.2016.
