JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 138 of 2014 registered for the offence under Sections-364A/34 of the Indian Penal Code.
Petitioners have been made accused in Complaint Case No. 138 of 2014 in which, prima facie case against the petitioners for the offence under Sections-364/34 of the Indian Penal Code has been found.
The contention on behalf of the petitioners is that prior to filing of the aforesaid complaint case, the complainant had given a petition to the Superintendent of Police, Sitamarhi and the Superintendent of Police, Sitamarhi got inquired the aforesaid petition and in course of inquiry, it came to light that the
Patna High Court Cr.Misc. No.11041 of 2015 (2) dt.20-03-2015 2/2 complainant's son had gone to Haidrabad in connection with his work and after that, he proceeded to Delhi and other places. Learned counsel for the petitioners further points out that the inquiry officer obtained joined bank account of so-called victim and his wife and it was found that the aforesaid joint bank account was still operational.
Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 138 of 2014 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
